Actually, Paraguay has crypto regulation for several years, although this information is unavailable in English, we have found it in Spanish. These regulations still are not totally clear and exist in the form of AML bylaws implemented by local Financial Intelligence Unit - SEPRELAD (7) in 2020.
SERPELAD had issued Resolution No. 8/20 (8), Resolution No. 9/20 (9), Resolution No. 314/21 (10). Based on these resolutions local VASPs should have compliance infrastructure including AML officer, proper policies, SEPRELAD registration and etc. Also after implementation of AML regulations in 2020-2021 local legislators tried to approve crypto bill. However, in July 2022 Paraguay’s president (7), Mario Abdo Benítez, vetoed a bill that sought to recognize cryptocurrency mining as an industrial activity. He reasoned that mining’s high electricity consumption could hinder the expansion of a sustainable national industry.
However, Congress has approved (9) new crypto bill one more time to pass the president’s veto. Finally the bill was rejected (10) in December 2022. In February 2024 local blockchain association recommended (11) legislators to create crypto regulation framework in the country. Despite that legislators took an attempt from local Senate to ban crypto mining, preservation and marketing of virtual assets. However, the corresponding bill submitted for consideration in April 2024 was rejected (12).
Cryptocurrencies and mining remain legal in Paraguay. However, state energy company ANDE will increase the price of electricity for legal miners. Local expert believes (13) that this initiative will only lead to an increase in corruption and the departure of legal miners into the shadows or their withdrawal of business from the country.
Despite all these difficulties, Paraguay has a unique situation in the region in the field of cryptocurrencies: excess electricity for mining attract here large mining companies like Bitfarms. Also Paraguay has low taxes (both PIT and CIT - 10%) and a territorial tax system within which income from the sale of cryptocurrencies can be exempt from taxes in some cases.
